Food Safety Act Puts Focus on Prevention

food safetyEven before the President signed the Food Safety Modernization Act, the passage of this legislation set in motion sweeping improvements to the security and safety of our nation’s food supply.

Each year, foodborne illness strikes 48 million Americans, hospitalizing a hundred thousand and killing thousands.

The historic legislation the President has signed directs the Food and Drug Administration, working with a wide range of public and private partners, to build a new system of food safety oversight – one focused on applying, more comprehensively than ever, the best available science and good common sense to prevent the problems that can make people sick.

The idea of prevention is not new. FDA has established prevention-oriented standards and rules for seafood, juice, and eggs, as has the U.S. Department of Agriculture for meat and poultry, and many in the food industry have pioneered “best practices” for prevention. What’s new is the recognition that, for all the strengths of the American food system, a breakdown at any point on the farm-to-table spectrum can cause catastrophic harm to the health of consumers and great disruption and economic loss to the food industry.

So, we need to look at the food system as a whole, be clear about the food safety responsibility of all of its participants, and strengthen accountability for prevention throughout the entire food system – domestically and internationally. The new law meets these needs in numerous ways.

  • For example, processors of all types of food will now be required to evaluate the hazards in their operations, implement and monitor effective measures to prevent contamination, and have a plan in place to take any corrective actions that are necessary. Also, FDA will have much more effective enforcement tools for ensuring those plans are adequate and properly implemented, including mandatory recall authority when needed to swiftly remove contaminated food from the market.
  • We (Congress) will, in accordance with the law, establish science-based standards for the safe production and harvesting of fruits and vegetables to minimize the risk of serious illnesses or death, and we will set standards for the safe transportation of food.
  • Moreover, with the signing of the law, FDA will for the first time have a congressional mandate for risk-based inspection of food processing facilities.  For example, all high-risk domestic facilities must be inspected within five years of enactment and no less than every three years thereafter.  

The legislation significantly enhances FDA’s ability to oversee the millions of food products coming into the United States from other countries each year.  (more…)

EPA RRP Deadline Looms; Thousands of Contractors not Certified (Taken from the Contractor Coaching Partnership)

The below is an excerpt of a blog post from The Contractor Coaching Partnership regarding their to-date experiences with the EPA’s Lead RRP. The final RRP Renovator Certification deadline is December 31st.

“On 12/31/2010 the EPA RRP Certified Renovator deadline ends. All contractors, landlords, property maintenance personnel, sub contractors and those who work for compensation on pre 1978 homes must be certified. Anyone who is not trained must not offer to work or work on pre 1978 homes or they will be subject to fines from the EPA. Current fines are up to $37,500 per day per offense.

On 6/18/2010 the EPA extension on fines and training caused a significant drop off for those seeking training. From 1/13/2010 to 6/30/2010 The Contractor Coaching Partnership facilitated the training for 3000 contractors. Since then we have only trained a little over 700.

Many contractors tell us they are not worried about becoming certified or getting caught because there have been no EPA fines.  In addition most building officials want nothing to do with the enforcement and many still have no clue as to what is going on with the law.

In our (The Contractor Coaching Partnership) outreach efforts we are finding that a significant percentage of contractors are not certifying their firms, not buying hepa vacuums, not implementing the practices, not setting up documentation and generally rolling the dice that the EPA will never mount a sustainable enforcement effort. They say homeowners don’t even know about the law and when it is brought up the homeowner says I don’t care and I don’t want to pay more.

What will 2011 bring?

Who knows what 2011 will bring. It is obvious that until the EPA or local building officials mount a significant enforcement effort that results in fines, wide contractor compliance will continue to move slowly. Meanwhile, compliant contractors who have stepped up to the plate, will have to deal with ineffective and non-existent enforcement in most areas. 

Will OSHA have an impact on enforcement?

The RRP Lead Law requires that contractors comply with OSHA Lead Laws. Most residential contractors have little or no experience with  the OSHA Lead in Construction Standard. However, contractors who don’t comply with it and get caught, face huge fines. In some states like Massachusetts, contractors are required to submit a respirator and worker protection program to obtain the lead license. The OSHA fines for serious violations are $7,000 and for willful violations $70,000. If OSHA starts enforcing the standard, these fines will likely have an indirect effect leading to RRP compliance.”

Kansas OSHA issues Grain National Emphasis Program; includes combustible dust

Following 2 fatalities in Russell, KS from a grain elevator collapse, the state’s OSHA office is cracking down on grain-related accidents with a new local emphasis program. According to OHSonline, OSHA said personnel from its Wichita Area Office will examine grain elevators, storage bins; rail cars; milling, fertilizer, feed, chemical, and farm machinery operations; and equipment repair and maintenance, with their inspections including hazard evaluations on fall protection, engulfment, fire, explosions from combustible dust, noise, confined spaces, and machine guarding. Kansas ranks first nationally in flour milling, wheat gluten production, and wheat stored, according to the state’s Department of Agriculture.

“The hazards associated with grain handling operations are well recognized, and allowing workers to enter grain storage facilities without proper equipment, precautions, and training can cost workers their lives,” said Charles E. Adkins, OSHA’s regional administrator in Kansas City, Mo. “OSHA’s Wichita Area Office will devote resources to outreach and enforcement activities in an effort to prevent workplace hazards and save lives.”

This program continues OSHA’s 2010 emphasis on grain operations. Assistant Secretary Dr. David Michaels sent a letter Aug. 4 reminding grain elevator operators about engulfment hazards.

The risk of a grain-related combustible dust fire or explosion can be greatly reduced with a strong and consistent maintenance plan.  OSHA recommends using a properly-equipped industrial vacuum cleaner (certified explosion-proof) to collect accumulations of dust on walls, pipes, and overhead areas. Don’t let the bed bugs bite…

Just the mention of bed bugs makes my skin itch; and lately, there have been a lot of mentions.  From hotels to planes to movie theaters, bed bugs are great hitchhikers; catching a ride on luggage, purses or clothing, our transient lifestyles have enabled easy travel for the buggers. Unfortunately, anyone can get bed bugs, no matter how clean you are; however there are somethings you can do to decrease your risk (besides enclosing your house in plastic).

  • Wash all bedding regularly in hot water. The water should be at least 120 degrees.
  • Vacuum floors and furniture regularly. Use the brush tool of your vacuum to vacuum your mattress. Use the crevice tool to vacuum crevices in the mattress and your baseboards. We recommend the GD10 Back or GD930.
  • Use a plastic cover over your mattress. Bedbugs can’t hide on the plastic cover.
  • If you purchase used furniture, examine it for bed bugs. Pay special attention to used mattresses and bed frames.
  • Check your own bed for bedbugs from time to time. Catching them early will make bedbug treatment easier if bedbugs do occur.
  • If you travel, inspect your luggage when  you return. If you find any, vacuum them off.

    Speaking of independence day, did you know Nilfisk vacuums have played a critical role in American historical events?  OK, so maybe they weren’t on the battlefield in Gettysburg (although the GM80 variable speed vac is currently used to clean artifacts from the period), but they have certainly become an icon since our founders Nielsen and Fisker first invented the electrically-powered dust collecting vacuum over 100 years ago (they also invented the Nimbus motorcyle!). Here are just a few of the celebrations…and tragedies the Nilfisk vacuum has been a part of; and the events that have helped shape the country we are today.  Happy 4th of July everyone!
